1. Developer & Trader Identity
These Terms of Service and End User License Agreement ("Terms") govern your use of the mobile applications, desktop software, web experiences, and games published by Drawk LLC ("we", "us", or "our"), including products published under our labels Drawlabs Game Studio (for games) and Drawcode (for utility and productivity apps). 2. Agreement to Terms & Eligibility
By downloading, installing, accessing, or using any of our applications or games, you agree to be bound by these Terms and our applicable Privacy Policy. If you do not agree, do not install or use our software. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian to use our software.
3. End User License Agreement (EULA)
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the software on authorized devices for personal, non-commercial entertainment or utility purposes. You agree not to: - Copy, modify, adapt, translate, or create derivative works of the software or any game assets. - Reverse engineer, decompile, decrypt, or disassemble the source code or binary files, except where permitted by applicable local law. - Sell, rent, lease, sublicense, distribute, or commercially exploit the software. - Bypass, disable, or tamper with any technological protection measures, DRM, or security controls.
4. Privacy & Data Protection
We prioritize your privacy and follow data minimization principles. Our software operates on an offline-first foundation whenever possible. We do not sell your personal data. Each application and game provides a dedicated Privacy Policy explaining its specific data practices, local storage usage, and hardware permissions. You can review the policy at any time on the product detail page or at /privacy.
5. In-Game Progression, High Scores & Virtual Items
Game progression, high scores, unlocked stages, and virtual items are licensed as part of the gameplay experience. They are stored locally on your device or synchronized with your platform account (such as Google Play Games Services or Apple Game Center). Virtual items and game progress possess no real-world monetary value, cannot be redeemed for cash, and are non-transferable. We are not responsible for lost local data resulting from clearing application storage, device resets, or operating system upgrades.
6. Intellectual Property & Authentic Art
All title, ownership rights, and intellectual property rights in and to our software (including code, gameplay designs, storylines, characters, authentic game art, logos, sound effects, and music) belong exclusively to Drawk LLC and its licensors. All rights not expressly granted to you are reserved.
7. App Store & Platform Rules
When downloading our software through an app store (such as Google Play or Apple App Store), you also agree to comply with the applicable terms of service and usage rules of that platform. In the event of a conflict between these Terms and platform rules, the platform rules govern to the extent of the conflict.
8. Software Updates & Changes
We may periodically release updates, patches, or improvements to ensure compatibility, address bugs, or enhance gameplay and performance. Some updates may download automatically depending on your device settings. We reserve the right to modify or discontinue any specific feature or online capability at our discretion.
9. Disclaimer of Warranties
Our software is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability & Consumer Rights
To the maximum extent permitted by applicable law, Drawk LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our software. Nothing in these Terms limits or excludes any statutory consumer rights that cannot be waived or restricted under applicable local consumer protection legislation, including laws within the European Economic Area (EEA), United Kingdom (UK), or your country of residence.
11. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Arizona and the United States, without regard to conflict of laws principles. You agree to submit to the jurisdiction of the state and federal courts located in Maricopa County, Arizona, subject to any mandatory local legal protections available to consumers.
